Terms of Service

1.About Apex

The website apexmarketmentor.com and the services described in these Terms are run by Apex Market Mentor And Advisor (Private) Limited (“Apex”, “we”, “us” or “our”). We are an education and mentoring company. We teach investing, leadership, career and business skills. We are not a stockbroker: we never hold, manage or trade your money or securities, and we never ask for access to your brokerage account.

2.Our Services

Our services (the “Services”) include:

• this website, including PSX Markets, articles and free learning resources;
• free course modules, workshops and PSX sector reports in our course library;
• the monthly Investor Circle package;
• the Investor Circle, a private WhatsApp group where members receive educational market views with explanations; and
• our training, career, startup and corporate programmes.

New features we add to the Services are also covered by these Terms.

3.Your Account

1. You need an account to buy a package or open paid content. When you register, you give us your full name, email address and contact number, and you choose a password. The information you give us must be true, complete and kept up to date.
2. Your account is for you alone. Keep your password secret and do not let anyone else use your account or share your access to paid content. You are responsible for everything done through your account unless it was caused by fraud that was not your fault.
3. Tell us straight away if you think someone else has used your account. We will never ask for your password over WhatsApp, email or phone.
4. You can ask us to close your account at any time by contacting us (see section 18).

4.Packages and Payment

1. Our packages and their current monthly prices are shown in Pakistani Rupees on the Investor Circle page. The price shown on the payment screen when you choose a package is the price you pay for that period.
2. Payment is made by bank transfer to the Apex company bank account shown on the payment screen. We only accept payment into the company account in the name of Apex Market Mentor And Advisor (Private) Limited. We will never ask you to pay into a personal account. If anyone does, do not pay and tell us.
3. After paying, send us a screenshot of the payment screen and your transfer receipt on WhatsApp from the number registered on your account. Your package is activated once we have confirmed that the payment has reached our account. We confirm payments during office hours (Monday to Saturday, 9:00 AM to 7:00 PM (PKT)), so messaging us within those hours means a faster activation.
4. Each package runs for 30 days from the day it is activated. Packages do not renew automatically. To continue, pay again before your package expires; a renewal paid before expiry starts from the end of your current period, so you do not lose any days.
5. When a package expires, access to its paid content ends, and Investor Circle members are removed from the WhatsApp group until they renew. We will try to remind you before your package expires, but renewing on time is your responsibility.
6. We may change our prices or the contents of a package. A change will not affect a period you have already paid for, and we will show the new price on the Packages page before it applies to you.
7. You are responsible for any charges your bank makes for sending the transfer.

5.Cancellation and Refunds

1. You can stop at any time simply by not renewing. There is no cancellation fee.
2. Because paid content and the Investor Circle become available as soon as a package is activated, fees for a period that has been activated are not refundable, in whole or in part.
3. If we are unable to activate a package you have paid for, or we withdraw a package during a period you have paid for, we will refund the unused amount to the account the payment came from.
4. If you pay twice by mistake or pay the wrong amount, tell us within 7 days. Once we have verified the payment, we will refund the extra amount or apply it to your next period, whichever you prefer.
5. Before any refund, we may ask for your transfer receipt and other details to confirm that the payment was yours.

6.Investment Risk Disclaimer

Everything we provide is for education. Please read this section carefully.

1. Our courses, reports, articles, charts, sessions and Investor Circle messages, including any buy or sell views shared in the Investor Circle, are educational opinions explaining how we analyse the market. They are general in nature. They do not take into account your finances, goals or appetite for risk, and they are not personal investment advice or a recommendation that a particular investment is suitable for you.
2. Every investment decision is yours alone, and so is its result. You should do your own research and, where appropriate, speak to a licensed investment adviser or your broker before investing.
3. Investing in shares and other securities carries risk. Prices go down as well as up, and you can lose some or all of the money you invest. Past performance, whether of a share, a market or one of our views, does not guarantee future results. We do not promise any profit or return.
4. Market data, prices and charts on the website may be delayed, incomplete or inaccurate and are not intended for trading decisions.
5. People at Apex may hold, buy or sell securities that are discussed in our Services.

7.Course Content and Intellectual Property

1. All content in the Services, including course modules, reports, slides, videos, articles, charts, Investor Circle messages, the AMMA name and logo and the design of this website, belongs to Apex or to those who have licensed it to us.
2. While your package is active, we give you a personal, non-transferable right to view the content included in it for your own learning.
3. You may not copy, download, record, screenshot for sharing, resell, publish or forward our paid content or Investor Circle messages to anyone outside your account or the group, or use them to run a competing service, without our written permission.

8.Investor Circle Group Rules

1. The Investor Circle is a private WhatsApp group. Other members of the group can see your WhatsApp name and phone number, as with any WhatsApp group.
2. Be respectful to other members. Do not post advertisements, spam, unrelated links or your own paid tips, and do not share or misuse other members’ contact details.
3. Do not forward the group’s messages outside the group.
4. Group admins may remove messages and may remove members who break these rules. A member removed for breaking these rules is not entitled to a refund.

9.Acceptable Use

When using the Services you must follow the law and must not:

• use the Services for anything fraudulent, misleading or unlawful;
• post or send content that is abusive, threatening, defamatory, obscene, hateful or that infringes anyone’s rights;
• impersonate anyone, or use someone else’s account;
• collect other users’ personal details without their consent;
• try to get around the protections on paid content, or access parts of the Services you are not entitled to;
• interfere with the website, overload it, scrape it with automated tools or introduce viruses or harmful code; or
• encourage anyone else to do any of these things.

We may investigate suspected breaches, remove content and take any action allowed by law.

10.Third-Party Services and Links

The Services rely on and link to services run by others, such as WhatsApp, banks, market data sources, YouTube, news websites and social media. We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is governed by their own terms.

11.Availability of the Services

We work to keep the Services available and accurate, but they are provided “as is” and “as available”. We do not promise that they will always be uninterrupted, error-free or free of viruses. The Services may be unavailable from time to time for maintenance, upgrades, internet problems or reasons beyond our control. We may change, suspend or discontinue any part of the Services; if this affects a package you have paid for, section 5.3 applies.

12.Limitation of Liability

1. To the extent permitted by law, Apex, its directors, staff and agents are not liable for any loss you suffer as a result of investment or trading decisions you make, whether or not you based them on our Services.
2. To the extent permitted by law, we are not liable for indirect or consequential losses, including lost profits, lost opportunities, lost data or damage to reputation.
3. To the extent permitted by law, our total liability to you for any claim connected with the Services is limited to the amount you paid us for the package period in which the claim arose.
4. Nothing in these Terms excludes any liability that cannot be excluded under the law of Pakistan.

13.Indemnity

You agree to compensate Apex, its directors, staff and agents for any claims, losses, damages and reasonable costs (including legal fees) brought by third parties that arise from your breach of these Terms, your misuse of the Services or of our content, or your breach of any law or of anyone else’s rights.

14.Suspension and Termination

We may suspend or close your account, remove you from the Investor Circle and end your access to the Services if we reasonably believe that you have broken these Terms, shared your access or our paid content, made a fraudulent payment, or used the Services in a way that could harm Apex or other members. Where it is reasonable to do so, we will warn you first. If your access ends because you broke these Terms, fees already paid are not refunded.

15.Changes to These Terms

We may update these Terms from time to time, for example when we add Services or when the law changes. The updated Terms will be posted on this page with a new “Updated as of” date, and we will tell you about important changes by email or WhatsApp. If you keep using the Services after the change, you accept the updated Terms. If you do not agree, please stop using the Services and do not renew your package.

16.Severability and Waiver

If a court finds any part of these Terms invalid, the rest of the Terms stay in force. If we do not enforce a right straight away, we have not given up that right.

17.Governing Law

These Terms, and any dispute arising out of or in connection with them or the Services, are governed by the laws of the Islamic Republic of Pakistan. The courts of Pakistan have exclusive jurisdiction. Before going to court, please contact us so that we can try to resolve the matter with you.
